Terms of Use

These Terms of Use outline the rules, responsibilities, and legal protections that apply when using Road Rescue Network’s platform, whether as a customer requesting roadside help or as a rescuer providing services.

Welcome to Road Rescue Network (“Company,” “we,” “us,” or “our”). By accessing or using our services, including our platform that connects drivers in need of roadside assistance with independent rescuers (“Service”), you agree to comply with the following Terms of Use (TOU).

These TOU govern the relationship between:

  • Customers (“Users”) who request roadside assistance, including but not limited to jump-starts, tire changes, fuel delivery, lockouts, and towing referrals.
  • Independent Rescuers (“Rescuers”) who perform services on an on-demand, as-available basis using their own vehicles, equipment, and discretion.
  • Road Rescue Network, which acts solely as a technology platform and coordination system to connect Users and Rescuers. Road Rescue Network does not directly perform roadside assistance services.

By using the Service, you agree to these TOU. If you do not agree, you must discontinue use immediately.

1. ACCEPTANCE OF TERMS

By accessing or using the Service, you acknowledge and agree that:

  • Road Rescue Network is not a roadside assistance provider. We operate solely as a technology platform that connects Users with independent Rescuers.
  • Customers contract directly with Rescuers, not with Road Rescue Network.
  • Rescuers are independent contractors, not employees, partners, or agents. We do not control when, how, or where they perform services.
  • Rescuers are solely responsible for maintaining all required licenses, insurance, and compliance with applicable laws.
  • We reserve the right to update these TOU at any time. Continued use of the Service after updates constitutes acceptance.

2. SERVICES OFFERED & LIMITATIONS

Through our platform, Road Rescue Network coordinates access to third-party Rescuers who may provide:

  • Light-duty roadside assistance (tire changes, jump-starts, lockouts, fuel delivery, etc.)
  • Towing referrals through independent towing companies
  • Other emergency roadside help as offered by Rescuers

What We Do Not Do:

  • We do not perform repairs, roadside assistance, or towing directly.
  • We do not guarantee that a Rescuer will be available at any given time.
  • We do not guarantee the quality, timeliness, or success of services.
  • We do not assume responsibility for damages, delays, or disputes arising from Rescuers.

By requesting service, Users acknowledge that work is performed exclusively by an independent Rescuer.

3. USER AGREEMENT & LIMITATION OF LIABILITY

By using the Service, Users agree to the following:

  • No Warranties: Road Rescue Network does not warrant or guarantee the outcome, safety, timeliness, or quality of services performed by Rescuers.
  • Limited Liability: We are not liable for damages, losses, injuries, or delays caused by Rescuers.
  • Customer Responsibility: Users must confirm costs, request estimates, and verify Rescuer suitability before approving any work.
  • Direct Resolution: Any dispute, damage, or legal claim must be pursued directly against the Rescuer, not Road Rescue Network.

Important: Road Rescue Network acts only as a connector. We are not a party to agreements between Users and Rescuers.

4. RESCUERS: INDEPENDENT CONTRACTOR STATUS

All Rescuers providing services via our platform:

  • Operate as independent contractors with complete discretion over whether, when, and how to accept service requests.
  • Are not employees of Road Rescue Network. No wages, benefits, or employment rights are provided.
  • Must obtain and maintain their own licenses, insurance, certifications, and equipment.
  • Assume full liability for all services performed.
  • Agree to comply with safety, industry, and legal standards.

No Employment Relationship:

  • Rescuers are free to accept or decline service requests.
  • Rescuers are not entitled to health insurance, workers’ compensation, unemployment benefits, or any other employee protections.
  • Road Rescue Network may suspend or remove a Rescuer for poor performance, complaints, or violations of these TOU.

5. PAYMENT TERMS

For Users:

  • Payment is due upon completion of service unless otherwise arranged.
  • All payments must be processed through Road Rescue Network’s platform. Users may not pay Rescuers directly outside the platform.

For Rescuers:

  • Compensation is remitted based on completed jobs and subject to the payment terms agreed upon during onboarding.
  • Road Rescue Network does not withhold payroll taxes; Rescuers are responsible for their own tax obligations.

6. NO WARRANTIES; LIMITATION OF LIABILITY

Disclaimer:

  • All services are provided “as is” without any warranties.
  • We do not guarantee the availability, quality, safety, or outcome of any service.
  • We are not liable for indirect, incidental, consequential, or punitive damages arising from use of the Service.

Maximum Liability:

  • Road Rescue Network’s maximum liability in any claim or dispute shall not exceed twenty-five dollars ($25.00).

7. INDEMNIFICATION

By using the Service, both Users and Rescuers agree to indemnify, defend, and hold harmless Road Rescue Network, its owners, affiliates, and employees from all claims, damages, losses, or disputes resulting from:

  • The actions, errors, or negligence of any Rescuer.
  • Service delays, failures, or damages caused by a Rescuer.
  • Contractual disputes between Users and Rescuers.
  • Any breach of these TOU.

8. TERMINATION OF SERVICE

Road Rescue Network reserves the right to:

  • Deny or discontinue service to any User or Rescuer at our sole discretion.
  • Suspend or remove Rescuers for misconduct, complaints, or noncompliance.
  • Modify, suspend, or discontinue the platform at any time.

9. GOVERNING LAW, ARBITRATION, & CLASS ACTION WAIVER

  • These TOU are governed by and construed under the laws of the state in which the service was provided, without regard to conflict of law principles.
  • Any dispute, claim, or controversy arising out of or relating to the Service or these TOU must be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
  • Arbitration shall take place in Montgomery County, Pennsylvania.
  • By using the Service, you agree to waive any right to a trial by jury.
  • By using the Service, you also agree to waive any right to participate in a class action, class arbitration, or representative action. All claims must be brought individually.
  • Any claims must be filed within 60 days of the incident or are permanently barred.

  • Road Rescue Network is a coordination platform only — not a service provider.
  • Customers contract directly with Rescuers.
  • Rescuers are independent contractors, not employees.
  • Road Rescue Network assumes no liability for damages, delays, or disputes.
  • Use of the Service is entirely at your own risk.

If you agree to these Terms, you may continue using our Service. If not, discontinue use immediately.
