RESCUER INSURANCE & INDEMNIFICATION POLICY
Rescuers on the Road Rescue Network platform must carry and maintain their own insurance coverage. Road Rescue Network provides no insurance for rescuers.
1. INDEPENDENT CONTRACTOR STATUS
All rescuers on Road Rescue Network (“RRN”) operate as independent contractors, not employees. As such:
- RRN does not provide wages, benefits, or insurance of any kind
- Rescuers are responsible for their own legal compliance, taxes, and insurance coverage
- Nothing in this policy alters the independent contractor relationship
2. REQUIRED INSURANCE COVERAGE
Rescuers must, at their sole cost, obtain and maintain the following insurance policies:
A. Commercial Auto Liability Insurance
- Minimum limits required by state law or $1,000,000 combined single limit, whichever is greater
- Coverage must include liability for bodily injury and property damage arising out of the operation of a rescuer’s service vehicle
- Rescuer’s personal or commercial auto insurance is primary; RRN provides no coverage
B. General Liability Insurance
- Minimum of $1,000,000 per occurrence and $2,000,000 aggregate
- Coverage for bodily injury, property damage, and personal injury arising out of rescuer’s services, including roadside operations and use of equipment
C. Workers’ Compensation / Occupational Accident Coverage
- As independent contractors, rescuers are not eligible for workers’ compensation through RRN
- Rescuers are solely responsible for securing their own occupational accident or workers’ compensation insurance to cover injuries to themselves or their workers, if applicable
D. Additional Insurance
- Any additional insurance required by federal, state, or local law must be maintained at rescuer’s expense
3. INSURANCE PROOF AND COMPLIANCE
- Rescuers must provide proof of insurance upon onboarding and upon request
- Policies must remain active and in good standing; lapses in coverage may result in suspension or removal from the platform
- Road Rescue Network reserves the right to verify coverage and deny access to rescuers who fail to comply
4. NO INSURANCE PROVIDED BY RRN
- RRN does not provide auto liability, general liability, workers’ compensation, occupational accident, health, disability, or any other insurance coverage for rescuers
- RRN disclaims all responsibility for rescuer accidents, injuries, or damages
5. INDEMNIFICATION & HOLD HARMLESS
By using the Road Rescue Network platform, rescuers agree to fully indemnify, defend, and hold harmless Road Rescue Network, its owners, affiliates, officers, employees, and contractors from any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from:
- Bodily injury, death, or property damage caused by rescuer actions, omissions, or negligence
- Failure to maintain required insurance coverage
- Accidents, injuries, or damages occurring during or in connection with rescuer services
- Violations of law, regulations, or this policy by rescuers
This indemnification obligation survives termination of a rescuer’s account.
6. LIMITATION OF LIABILITY
- RRN’s liability in connection with rescuer services is strictly limited as described in the Terms of Use
- RRN shall not be liable for incidental, indirect, consequential, or punitive damages arising from rescuer activities
- Maximum liability of RRN, if any, is limited to $25.00 as set forth in the Terms of Use
7. CONSEQUENCES OF NON-COMPLIANCE
Failure to maintain required insurance or comply with this policy may result in:
- Suspension or deactivation of rescuer’s account
- Denial of access to service requests
- Reporting to regulatory authorities if required by law
8. FINAL REMINDERS
- Rescuers are independent contractors and must insure themselves
- RRN provides no insurance coverage of any kind
- Rescuers assume all risk of injury, loss, and liability while performing services
- RRN is fully indemnified and held harmless from and and all rescuer actions
